LEMON LAW

Simply put, LEMON LAWs give consumers legal rights and remedies when they purchase a consumer product that comes with a warranty and turns out to be defective. Consumer products are defined as products that are normally used for either personal, family or household purposes. Therefore, LEMON LAW, although commonly known to apply to automobiles also applies to products such as computers, TVs, refrigerators, boats, RVs, and any other consumer product, which costs $25.00 or more. The uniqueness of LEMON LAW is that manufacturers must pay the attorney fees of a consumer who prevails in court or through an out-of-court settlement.

KEEP GOOD RECORDS OF PURCHASE AND REPAIRS

Whenever you purchase any consumer product, retain purchasing documentation and warranty information. When the product is in need of repair, retain all repair documentation. Ask the repairmen to indicate the cause of the problem on the repair order and actions taken to repair the product. When presented with clear proof that the product does not perform in accordance with its standards, most of the manufacturers will be more likely to offer you a satisfactory settlement.


CONSUMER FRAUD

Consumer Fraud takes many forms. One of the most common is auto fraud. Fraud may be committed by an automobile dealership by misrepresenting or failing to disclose such things as the true condition of the vehicle (i.e., whether the vehicle was involved in an accident or sustained some type of damage when in possession of a prior owner), the true mileage of a vehicle or the true ownership history of the vehicle. Fraud may also occur when a dealership allows a consumer to take delivery of a vehicle prior to obtaining financing, promises to obtain financing, fails to do so, and then refuses to return the consumer’s down-payment or trade-in vehicle.

What is the probability of success? The majority of cases settle prior to trial to the satisfaction of the clients.
How long does it take? While some cases are resolved within a few weeks after you contact an attorney, other cases may take longer. The lengths of the process depends on the type of the case, co-operation of the defendant, and the ability of our clients to provide information to us in a timely manner.
What do I get if I win?

In majority of cases involving defective vehicles, clients will receive cash compensation for their damages and retain ownership of their cars.
In about 20 percent of cases, the manufacturer will refund the purchase price of the car with a deduction for the value received (determined by the miles driven at the time of refund). In some cases, the manufacturer will replace the defective car with a new car.
